Terms of Use

Please read these Terms of Use (“Terms”) carefully before using DayMark (“the App”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Description of Service

DayMark is a countdown app that lets you track how many days remain until — or have passed since — the events that matter to you. The App allows you to count down to a future date or count up from a past one, organize events by category, set reminders, view a progress bar and percentage for each event, and use a workdays-only mode that follows your own work week. DayMark Pro additionally offers home screen and lock screen widgets, iCloud sync across iPhone and iPad, a day-of celebration screen, shareable countdown cards, milestones within a countdown, notes and a mood journal per event, and an insights dashboard. Your countdown data is stored locally on your device by default. Pro users on iOS may additionally opt in to iCloud sync from within the App.

2. Acceptance of Terms

By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.

3. User Accounts

DayMark does not require account creation. No registration or email is needed to use the App. All of your data lives on your device unless you choose to enable iCloud sync (DayMark Pro, iOS only).

4. Free and Paid Features

Free Plan: The App provides core countdown features at no cost, including: up to 3 countdowns, 1 reminder per event, count down and count up modes, organization of events by category, a progress bar and percentage for each event, and workdays-only mode that follows your own work week.

DayMark Pro (Paid Subscription): Additional features are available through an optional in-app subscription, including: unlimited countdowns, home screen and lock screen widgets, iCloud sync across iPhone and iPad, a day-of celebration screen, shareable countdown cards, milestones within a countdown, notes and a mood journal per event, and an insights dashboard with category breakdowns and your Year in Review.

5. Subscriptions and Payments

DayMark Pro is available as an auto-renewable subscription. Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription price.

You can manage and cancel your subscription at any time through your device’s App Store or Google Play Store settings.

No refunds will be provided for any unused portion of a subscription period, except as required by applicable law or the policies of Apple or Google.

6. Your Data

All countdown data you create is stored locally on your device. You are solely responsible for maintaining backups of your data.

Pro users on iOS may optionally enable iCloud sync from the in-app Settings. When enabled, DayMark stores copies of your countdown database in your personal iCloud container under your Apple ID. We do not have access to this data — it is handled entirely by Apple. iCloud sync resolves conflicts on a last-write-wins basis, is an added layer of redundancy, does not change the fact that your data is user-owned, and is not a substitute for your own backups. We are not responsible for iCloud outages, Apple ID issues, or data loss arising from your iCloud account.

Uninstalling the App will permanently delete all locally stored data. Disabling iCloud sync or deleting iCloud data (from the App or from iOS Settings → Apple ID → iCloud) will permanently remove those copies as well. We are not responsible for any loss of data resulting from device failure, app deletion, or any other cause.

7. Acceptable Use

You agree not to: reverse engineer, decompile, or disassemble the App; modify, adapt, or create derivative works based on the App; distribute, license, sell, or commercially exploit the App; use the App for any unlawful purpose; or attempt to gain unauthorized access to any systems or networks connected to the App.

8. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to its design, code, graphics, icons, and content, are owned by DayMark and are protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or logos.

9. Third-Party Services

The App uses the following third-party services, each governed by their own terms: RevenueCat (for subscription management); Apple iCloud (for optional Pro sync storage on iOS, under your own Apple ID); and the Apple App Store and Google Play Store (for app distribution and payment processing).

DayMark performs no external tracking and makes no server calls with your data. All insights and statistics are computed locally on your device. We do not collect, transmit, or share the event titles, dates, notes, journal entries, or any other content you create.

10. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: the App will be uninterrupted, timely, secure, or error-free; the results obtained from the App will be accurate or reliable; or the App will meet your specific requirements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAYMARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We reserve the right to terminate or restrict your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the App at any time by uninstalling it from your device.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

14. Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and your use of the App. Your use of the App may also be subject to other local, state, national, or international laws.

Disputes Resolution — If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us.

For European Union (EU) Users — If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DayMark regarding your use of the App.
